NEW BUSINESS:

MOTION TO APPROVE 2019 BUDGET (ALL FUNDS) WAS MADE BY DENNIS ANTONELLI, SECONDED BY JOHN BIROS.  ALL IN FAVOR, MOTION CARRIES.

MOTION APPROVE PAST DUE WAGES FOR DANIEL GALLAGHER IN THE AMOUNT OF $5,450.08 WAS MADE BY DENNIS ANTONELLI, SECONDED BY JOHN BIROS.  ALL IN FAVOR, MOTION CARRIES.

MOTION TO BUY-BACK VACATION TIME FOR 2018 FOR DANIEL GALLAGHER IN THE AMOUNT OF $1,343.44 WAS MADE BY DENNIS ANTONELLI, SECONDED BY JOHN BIROS.  ALL IN FAVOR, MOTION CARRIES.

MOTION TO TRANSFER $23,424.00 FROM THE LST FUND TO THE GENERAL FUND WAS MADE BY DENNIS ANTONELLI, SECONDED BY JOHN BIROS.  ALL IN FAVOR, MOTION CARRIES.

MOTION TO APPROVE TAX ANTICIPATION LOA UP TO $80,000.00 FROM LUZERNE BANK STRUCTURED TO BE DRAWN AS NEEDED.  APPROVAL IS GRANTED TO THIS EFFECT TO JANUARY 31, 2019 WAS MADE BY DENNIS ANTONELLI, SECONDED BY JOHN BIROS.  ALL IN FAVOR, MOTION CARRIES.

PUBLIC PARTICIPATION:  JILL CAREYVA QUESTIONED BACK PAY WAGES FOR DAN GALLAGHER-THE PAST TREASURER NEVER PAID HIM THE RIGHT AMOUNT OF MONEY.  MIKE KAKALEY ASKED ABOUT THE DRILLING BEING DONE BY HIS HOUSE AND WHAT HAPPENED TO THE PLANNING MEETING THAT WAS SCHEDULED, NOTHING WAS SCHEDULED FOR PLANNING MEETING.  DENNIS ANTONELLI SAID THIS IS JUST A SPECIAL MEETING TO APPROVE THE BUDGET AND OUR REGULAR MEETING WILL BE JANUARY 7, 2019 IF HE HAS ANY MORE QUESTIONS.  JILL CAREYVA QUESTIONED WHY WE NEED A LOAN-OUR GENERAL FUND IS DWINDLING AND THIS LOAN IS JUST TO COVER EXPENSES UNTIL WE GET TAX MONEY IN, WE WILL ONLY DRAW WHEN NEEDED.

DISCUSSION WILL TAKE PLACE ON BILL FOR ONEIDA PROJECT, DENNIS ANTONELLI SAID THE CATCH BASINS WERE TOO HIGH AND IT SHOULD’VE BEEN CORRECTED AT THE TIME AND THEY WILL DO A WALK AROUND AND CHECK THE WORK THAT WAS DONE.  MOTION TO TABLE PAYMENT TO M & J EXCAVATION WAS MADE BY DENNIS ANTONELLI, SECONDED BY JOHN BIROS.  ALL IN FAVOR, MOTION CARRIES.

PUBLIC PARTICIPATION:  MIKE KAKALEY WANTS A WRITTEN DESCRIPTION OF THE CONDITIONAL USE HEARING.  TOM HOUSER WANTED AN EXPLANATION OF THE TRANSFER OF FUNDS TO THE GENERAL FUND AND HOW WE INCUR THE INCOME FROM THE LST FUND AND ZONING FUND.  DAVE LAPINSKI WANTS AN ORDINANCE FOR BURNING GARBAGE-ATTORNEY WILL LOOK INTO IT.  JILL CAREYVA WANTS TO THANK THE ROAD WORKERS FOR THEIR EFFORTS WITH THE DOWNED TREES AND ICY PATCHES ON THE ROADS.  LOIS CASEY THANKED THE POLICE DEPARTMENT FOR THE DONATION TO THE TOWN CHRISTMAS PARTY.  STEVE BUSHINSKI –MINUTES ARE VERY DETAILED AND THE SECRETARY IS DOING A GREAT JOB.  IN 2019, WE SHOULD CONSIDER PUTTING MINUTES AND THE TREAURERS REPORT OUT BEFORE THE MEETINGS.  IF PEOPLE WERE ABLE TO SEE THE REPORTS BEFORE THE MEETING IT COULD SHORTEN THE READINGS.  HE ALSO SAID THE TREASURER IS GIVING A GREAT DETAILED REPORT AND IS ALSO DOING A WONDERFUL JOB.  THERESA GAIZICK-WANTS TO INITIATE EMA COORDINATION FROM THE TOWNSHIP FOR EMERGENCY NOTIFICATION. ROUTE 924 IS THE ONLY ROAD THROUGH THE TOWN AND PEOPLE SAT FOR HOURS COMING FROM HUMBOLT DURING THE STORM–NOT KNOWING WHAT WAS GOING ON.  SHE WAS IN CONTACT WITH CANDO AND THE SCHOOL DISTRICT ABOUT THE NOTIFICATION SYSTEMS.  DENNIS ANTONELLI TOLD HER TO SET UP A COMMITTEE TO WORK ON THIS AND SHE SAID SHE WILL LOOK FOR HELPERS.  BOB GABARDI- THE PROBLEM WITH THE STORM WAS PRIVATE CONTRACTORS WERE NOT PUT INTO EFFECT AND TRACTOR TRAILERS WERE DRIVING EMPTY.  STEVE BUSHINSKI-WHAT IF SOMETHING HAPPENS TO THE BUILDING AND RECORDS, WHAT KIND OF BACK-UP DO WE HAVE.  WE SHOULD REACH OUT TO SCHUYLKILL COUNTY EMA TO SEE WHAT THEIR IDEAS ARE.

MOTION TO ELIMINATE PAID POSITION OF ROADMASTER AND ALLOW ALL 3 SUPERVISORS TO ACT AS ROADMASTER WITH NO ADDITIONAL COMPENSATION EFFECTIVE IMMEDIATELY WAS MADE BY JOHN BIROS, SECONDED BY DENNIS ANTONELLI.  ALL IN FAVOR, MOTION CARRIES.

MOTION TO APPROVE DONATION OF $206.00 FROM EASGLE ROCK TO POLICE DEPARTMENT TO BE USED FOR POLICE EQUIPMENT UPON APPROVAL WAS MADE BY DENNIS ANTONELLI, SECONDED BY JOHN BIROS.  ALL IN FAVOR, MOTION CARRIES.  MATT WILLIAMS ELABORATED SAYING THEY PLAN ON USING IT FOR THE KIDS CHRISTMAS PARTY.

DISCUSSION ON PAY RAISE FOR TREASURER, DENNIS ANTONELLI EXPRESSED OUR NEW TREASURER IS DOING A LOT OF EXTRA WORK AND A RAISE IS WARRANTED.  HE IS CLEANING UP THE ERRORS FROM THE LAST TREASURER AND IS DOING IN HOUSE PAYROLL WITH A SAVINGS OF $3,120.00-$3,900.00 PER YEAR, RETURNED THE TELLER MACHINE TO LUZERNE BANK AT A SAVINGS OF $900.00/YR, HE WILL BE WORKING WITH THE AUDITORS TO PREPARE FINANCIAL DISCLOSURES FOR THE STATE AND IT WOULD ELIMINATE THE NEED FOR AN OUTSIDE CPA, SAVING THE TOWNSHIP $5,500.00/YR.  ALSO, WILL BE DOING THE BUDGET.

STEVE BUSHINSKI SPOKE ABOUT THE RAISE AND HOW THE NEW TREASURER WAS HIRED.  HE DOESN’T UNDERSTAND HOW THE DECISION WAS MADE.  HE ALSO THINKS THERE SHOULD BE A 6 MONTH PROBATION PERIOD BEFORE GIVING A RAISE.  THERESA GAIZICK SPOKE ABOUT HOW HARD MIKE HAS BEEN WORKING TO STRAIGHTEN THINGS OUT.  HE WASN’T AT THE MEETING BECAUSE THE MEETING WAS CHANGED TO A THURSDAY AND WOULD BE HERE AT A WEDNESDAY MEETING.  HE IS VERY QUALIFIED AND HAS MANY GOOD RECCOMMEDATIONS.

MOTION FOR PAY RAISE FOR TREASURER MIKE GAIZICK TO $10,725.00 PER YEAR WAS MADE BY DENNIS ANTONELLI, SECONDED BY JOHN BIROS.  ALL IN FAVOR, MOTION CARRIES.

BOB GABARDI-UPDATE ON TREASURER’S CASE.  PAM HARTZ-SOLUTION ON CAT PROBLEMS.  THERE IS AN ANIMAL ORDINANCE IN PLACE AND MAKE PEOPLE ACCOUNTABLE AND ALSO IN THE QUALITY OF LIFE ORDINANCE AND IT MUST BE ENFORCED AND FINE THE PEOPLE.  ATTORNEY BARANKO WILL REVIEW IT.  CODE ENFORCEMENT-PEOPLE DOING WORK IN THE TOWNSHIP WITHOUT INSURANCE AND PERMITS.  RON HARTZ IS DOING WORK IN THE TOWNSHIP ILLEGALLY-HE CAN BE FINED BECAUSE HE IS A FELON.  JOHN BIROS SAID IF WE DO FOR ONE WE MUST DO FOR ALL.  ANYONE AS A CONTRACTOR IS REGISTERED WITH THE STATE AND MUST REGISTER WITH CODE AND ZONING OFFICER.  MATT WILLIAMS WILL WORK WITH MARIO AND CHECK THIS OUT.  LANDLORDS IN THE TOWNSHIP MUST PAY OCCUPANCY FEE AND PER CAPITA TAX FEE.  THIS SHOULD BE ENFORCED.  THEY SHOULD BE PUT ON TAX ROLES TO PAY PER CAPITA TAX.  DENNIS ANTONELLI SAID WE ARE LOOKING INTO INSPECTION AND OCCUPANY PERMITS TO BE ENFORCED.

FOLLOW UP ON OLD MILL ROAD-DENNIS LOOKED AT PAVING AND IT WILL NOT BE ABLE TO BE DONE UNTIL NEXT YEAR BECAUSE WE ARE DOWN TO 2 EMPLOYEES AND WANTS TO PUT IT ON AGENDA FOR NEXT SPRING.  DAVE WALASAGE SAID THE ROAD NEEDS A CROWN ON IT AND THE COUNTY IS PLANNING ON FIXING THE BRIDGE AND MAYBE WE WANT TO WAIT ON THE PROJECT.

TREASURER’S ITEMS FOR APPROVAL-RECOMMENDED THE BOARD OF SUPERVISORS APPROVE IN ONE MOTION:  THE SUPERVISORS ALLOW THE TREASURER TO ESTABLISH A SEPARTE CHEKING ACCOUNT FOR PAYROLL WITHIN THE GENERAL FUND IN WHICH NET PAYROLL WILL BE DEPOSITED AND ALL PAYROLL CHECKS ARE TO BE DRAWN AGAINST IT.  THIS IS DONE TO INCREASE CONTROL AND PREVENT FRAUD. PAM HARTZ-ANIMAL CONTROL-STRAY CATS ARE OUT OF CONTROL.  TRAP AND RELEASE IS ILLEGAL AND CAN’T BE DONE.  CATS ARE DESTROYING PROPERTIES.  FERAL CATS NEED TO BE EUTHANIZED.  SHE WANTS PEOPLE TO BE HELD ACCOUNTABLE FOR KEEPING AND FEEDING THE STRAY CATS.   LORRAINE SHENYO SAID THERE ON CATS ON PORCHES IN HER NEIGHBORHOOD.  DENNIS ANTONELLI ASKED PAM IF SHE WOULD TAKE CARE OF THE SITUATION AND SHE SAID SHE WOULD.  WE WILL DISCUSS IT NEXT MONTH.  ROOSTERS AND DUCKS ARE BECOMING A PROBLEM ALSO.  PAM SAID WHEN SHE WAS ANIMAL CONTROL OFFICER SHE GAVE PEOPLE INFORMATION ON STRAY CATS AND THEY DIDN’T WANT TO BE BOTHERED WITH IT.

TOM HOUSER ASKED ABOUT THE SALARY OF NEW TREASURER-IS HE ACCEPTING THE NEW PAY RATE.  THEY ARE CONTESTING THE RE-ZONING AND WHAT IS BEING DONE.  THERE IS AN APPEAL HEARING ON OCTOBER 1, 2018.

BILL FELLIN-NEVER SAW MARIO IN ONEIDA-PROPERTIES ARE FALLING APART AND GARBAGE ALL OVER AND WANTS TO SEE MARIO ON THE JOB.  MARIO WILL MEET WITH HIM.  ASKED JON DETTERY ABOUT HIS BACK TAXES AND HOW CAN HE TAKE A SALARY FROM THE TOWNSHIP AS ROADMASTER AND NOT PAY THEM.  IT’S NOT RIGHT.  JON DETTERY SAID HIS TAXES WERE PAID.

WILLIAM GEORGE-THE DITCH AT THE BOTTOM ON HEMLOCK DRIVE ARE FILLING UP WITH LEAVES AND SHOULD BE FILLED IN WITH ROCK.  DANNY GALLAGHER WILL LOOK AT IT.  MIKE KAKALEY-HAVE ANY PLANS BEEN SUBMITTED BY DOLLAR GENERAL, IT GOES TO THE PLANNING COMMISSION.  IF THEY UPROOT TREES ON PROPERTY AND CREATE DAMAGE TO HIS PROPERTY AND HOW ARE THEY PLANNING TO RUN THE SEWAGE SYSTEM.  DAVE LAPINSKI=GREEN MOUNTAIN ROAD BURNING AND CALLED THE POLICE.  MATT SAYS NOTHING CAN BE DONE UNDER THE ORDINANCE.  A QUALITY OF LIFE TICKET MUST BE ISSUED AND GIVE A 20 DAY NOTICE IN ORDER TO CORRECT THE PROBLEM AND IF IT’S NOT DONE IT GOES TO A LOCAL CITATION.  MATT HAS BEEN THERE 2 TIMES AND HE CANNOT GIVE THE CITIZEN A CITATION IN THIS SITUATION.  MARIO CURELLI OR KYLE MUMMEY ARE ABLE TO ISSUE THE CITATIONS.  WE DON’T HAVE A BURNING ORDINANCE IN THE TOWNSHIP.  DENNIS SAID WE MIGHT HAVE TO GO WITH A BURNING ORDINANCE AND WE WILL LOOK INTO IT.  JILL CAREYVA-SAID THE ROAD CREW DID A GREAT JOB WITH THE CURRENT RAIN STORMS.

OLD BUSINESS: MOTION TO RE-ZONE PROPERTY ON SR 924 APPROXIMATELY ¼ MILE NORTH OF SCHOOL HOUSE ROAD FROM CR TO C-2.  TOM HOUSER ASKED IF THE COUNTY ZONING BOARD NOTIFIED THE TOWNSHIP ABOUT THE FINDINGS REGARDING HOW THE REZONING FIT WITH THE COUNTY’S COMPREHENSIVE PLAN.  ATTY BARANKO STATED THE TOWNSHIP RECEIVED THE LETTER AND THE COUNTY DOES NOT BELIEVE IT WAS NOT CONSISTENT TO THE COMPREHENSIVE PLAN.  ATTY BARANKO STATED MR BIROS’ ABSTENTION SUBJECT TO THE ETHICS ACT $1103(j) AND NOTED HE HAD CONTACTED THE PA STATE ETHICS COMMISSION REGARDING EXCEPTIONS TO THE ABSTENTION AND HE RECEIVED QUALIFICATION ON THEM.  ATTY BARANKO READ THE CONFICT OF INTEREST AND IS ATTACHED TO THESE MINUTES.  DENNIS ANTONELLI QUESTIONED THE ETHICS OPINION AND DOESN’T THINK MR BIROS HAS THE AUTHORITY TO VOTE, ATTY BARANKO IS TAKING FULL RESPONSIBILITY ON THIS MATTER.  JON DETTERY MADE A MOTION TO APPROVE THE APPLICATION TO CHANCE THE ZONING, DENNIS ANTONELLI WOULD NOT SECOND THE MOTION.  PURSUANT TO THE ETHICS ACT THE MOTION WAS THEN BROUGHT TO THE TABLE BY ABSTAINING/CONFLICTS JOHN BIROS.  ROLL CALL TO VOTE, SUPERVISOR ANTONELLI-NO, SUPERVISOR DETTERY-YES, SPLIT VOTE, TIE BREAKER VOTE PURSUANT TO ETHICS ACT BIROS-YES.  APPLICATION IS APPROVED AND WILL MOVE ON TO THE ZONING BOARD.

MOTION TO APPROVE RESIGNATION OF TREASURER OF MARY STITZER.  MOTION TO APPROVE WAS MADE BY DENNIS ANTONELLI, SECONDED BY JOHN BIROS.  COMMENTS-PAM HARTZ ASKED MR DETTERY IF HE APPROVED TREASURER’S PAY RAISE AND HE SAID FOR THE PAST 2 MEETINGS HE KNEW NOTHING ABOUT IT BUT HE SIGNED A NOTARIZED LETTER STATING HE APPROVED IT.  MR DETTERY EXPLAINED IN THE PAST MEETINGS IT WAS A RECENT PAY RAISE, HE IS ONE BOARD MEMBER AND SAID PUT IT ON THE AGENDA FOR IT TO BE APPROVED.  DENNIS ANTONELLI READ THE NOTARIZED LETTER AUTHORIZING THE PAY RAISE.  ATTY BARANKO SAID IT MUST BE REFERRED TO THE AUDITORS.  PAM HARTZ CALLED FOR JON DETTERY’S RESIGNATION BECAUSE HE VIOLATED THE SUNSHINE ACT.  PAM THEN CALLED FOR HIS RESIGNATION.  DENNIS ANTONELLI SAID AT THE LAST 2 MEETINGS HE CLAIMED HE KNEW NOTHING ABOUT THE RAISE AND AFTER THE LAST MEETING HE HAD SIGNED A LETTER STATING THAT HE DID APPROVE THE RAISE.  JON DETTERY SAID HE DID NOTHING WRONG.

BOB GABARDI-AUDITORS ARE ASKING FOR THEIR OWN COUNSEL TO FIND OUT WHO IS RESPONSIBLE FOR ALL THE MONEY THE TREASURER GOT PAID.   ATTY BARANKO ADVISES THAT IT WOULD BE IN THE BEST INTEREST FOR THE TOWNSHIP TO DO THIS.  DENNIS ANTONELLI MADE A MOTION FOR AUDITORS TO OBTAIN AN OUTSIDE ATTORNEY AT NO MORE THAN WHAT WE PAY ATTORNEY BARANKO WHICH IS  $95.00 PER HOUR.  SECONDED BY JOHN BIROS.  ALL IN FAVOR, MOTION CARRIES.

MOTION TO HIRE MICHAEL GAIZICK AS TREASURER AT $6,000.00 PER YEAR.  MOTION TO APPROVE WAS MADE BY DENNIS ANTONELLI, SECONDED BY JOHN BIROS.  ALL IN FAVOR, MOTION CARRIES.

MATT WILLIAMS WILL ADDRESS THE SITUATION.  BOB FERRARI COMMENTED ON TRASH IN ALLEY BY HIS HOUSE.  MATT WILLIAMS SERVED NOTICE OF VIOLATION TWO WEEKS AGO, HE WILL GO AND CHECK ON IT.  JOHN GROHOL-4 WHEELERS ARE RACING UP AND DOWN THE HIGHWAY AFTER 8PM AT NIGHT, MATT WILLIAMS KNOWS A LOT OF THE LOCALS THAT RIDE AND WILL SPEAK TO THEM.  THE POLICE CANNOT CHASE THEM DUE TO LIABILITY.  TOM HOUSER-ASKED IS THE RE-ZONING, SPOT ZONING.  C-2 SURROUNDED BY ANOTHER ZONE.  ATTY BARANKO STATED THE COURT MUST DECIDE.  SANDY MUMICH-WANTS SOMETHING DONE ABOUT SPEEDING ON SCHOOLHOUSE ROAD.  BILL MCMULLIN SAID IT CAN ONLY BE 35 MPH DEPENDING ON CERTAIN CRITERIA.  ATTY BARANKO WILL GET INFORMATION TOGETHER ON CHANGING SPEED LIMIT.

PUBLIC PARTICIPATION: STEVE BUSHINSKI URGES BOARD TO CONTACT NORTH UNION TOWNSHIP ABOUT CHANGING NAME OF GREEN MOUNTAIN ROAD IN BRANDONVILLE.  IT’S GETTING VERY DANGEROUS WITH THE TRUCK TRAFFIC. SIGNS ARE NOT WORKING.  BOB GABARDI-GAVE UPDATE ON QUARTERLY AUDIT, A RESOLUTION SHOULD BE MADE BEFORE BILLS AND TRANSFERS IN ACCOUNTS ARE BEING DONE.  ALSO, WHEN MAKING A CAPITAL PURCHASE NO PERSONAL CREDIT CARDS SHOULD USED.  MARIO CURELLI-WANTS TO KNOW WHY NO FINANCIAL DISCLOSURES ARE IN THE NEWSPAPER YEARLY-ATTY BARANKO WILL CHECK ON THE RULING.  THE CPA FIRM HAS 2016 TO AUDIT AT THE PRESENT TIME.  ALSO, HOW MUCH ROCK SALT WAS USED ON THE ROADS-THEY COULD’VE USED MORE THIS PAST WINTER-HE WAS CONCERNED THERE WASN’T ENOUGH DONE THIS WINTER. SUPERVISORS SAID 100-120 TONS WERE USED.  HE ALSO QUESTIONED IF JON DETTERY WAS ABLE TO HAVE A GARBAGE TRUCK SITTING IN RESIDENTIAL PROPERTY.  DAN GALLAGHER-WANTED AN UPDATE ON THE BACKHOE-ATTORNEY BARANKO SAID VOLVO WILL NOT DO ANYTHING ABOUT IT AND WE ARE WAITING TO HEAR BACK FROM HIGHWAY EQUIPMENT IF THEY WOULD HELP OUT IN ANY WAY.  THE LAWN TRACTOR IS ROTTED OUT-NOT SAFE TO USE.  DANNY WAS ALSO QUESTIONED ABOUT A BILL FROM TEAM SUPPLY-JON DETTERY SAID HE ORDERED IT.  AT A PREVIOUS MEETING JOHN BIROS SAID ALL THE SUPERVISORS HAD THE CODE FOR THE GPS ON POLICE CARS AND DENNIS ANTONELLI KNEW NOTHING ABOUT IT.  JOHN BIROS SAID IT WAS HANDLED BY LISA DAVIDSON AND HE KNEW NOTHING ABOUT IT-IT WAS DONE IN 2014.  DANNY STATED THE TOWNSHIP CLEAN UP IS OUT OF CONTROL. 40-50% IS COMING FROM OUTSIDE OF THE AREA AND A LOT OF IT CAN BE RECYCLED.  NO OTHER TOWNSHIP DOES ANY CLEAN UP ANYMORE BECAUSE OF THIS ISSUE.

STEVE BUSHINSKI ASKED WHY IS THE TIME FOR THE TOWNSHIP MEETING TO BE CHANGED TO 4:00PM AND SUPERVISORS SHOULD CONSIDER RESIDENTS BEING ABLE TO ATTEND -JOHN BIROS SAID IT IS CONVENIENT TIME FOR THE BOARD TO MEET. STEVE ALSO QUESTIONED WHY THERE IS NO ROADMASTER. DANNY GALLAGHER ASKED WHY WE ARE PUTTING SO MUCH EXPENSE INTO THE CHERNISKY PROPERTY-JOHN BIROS SAID WE ARE TRYING TO CLEAN UP BLIGHTED PROPERTIES IN THE TOWNSHIP AND LOOKING FOR GRANT MONEY AVAILABLE TO DO IT.
