PUBLIC COMMENTS: ADELE ZAREMBA THANKED JOHN BIROS FOR THE NEWSLETTER PRESENTED TO THE PUBLIC. ANIMAL CONTOL OFFICER PAM HARTZ GAVE A BRIEF REPORT HER ASSESSMENT OF THE AMINAL SITUATION IN THE TOWNSHIP. WE WILL POST ON WEBSITE AT BEGINNING OF YEAR THAT ALL DOGS MUST BE LICENSED AND ALL DOGS AND CATS HAVE RABIES SHOTS. BOB GABARDI QUESTIONED FIRE HYDRANTS BEING PAID OUT OF FIRE FUND. HE ALSO COMMENTED ON FIRE COMPANY RECEIVING A RIGHT TO KNOW REQUEST FOR THE FIRE COMPANY FUNDS. HE FELT THAT THE FIRE COMPANY DOES
NOT HAVE TO GIVE THAT INFORMATION TO THE TOWNSHIP. ATTORNEY O’DONNELL ADVISED HIM THAT THEIR ATTORNEY SHOULD HAVE RESPONDED TO THE RIGHT TO KNOW REQUEST IF THEY FELT THEY DID NOT HAVE TO COMPLY.

JOE BROWN STATED THAT JERRY IS LOSING INCOME FROM NOT BEING EMPLOYED BY THE TOWNSHIP ANY LONGER. JIM YURICK SAID HE WANTED THE NEW POLICE VEHICLE OUT OF HIS GARAGE. DREW MAGILL SPOKE ABOUT THE CARGO AIRPORT EXTENSIVELY. HE URGED TO KEEP RESISTING IT. LOIS CASEY HAD A COMMENT ON JON DETTERY AND JOE DELUCA BEING ROADMASTERS AND THE ISSUE WITH THE PAY THEY RECEIVED. JOE BROWN STATED THAT WHEN HE WAS EMPLOYED BY THE TOWNSHIP, JON DETTERY WAS THE ONLY SUPRVISOR WHO WORKED ALONGSIDE THE GUYS. THE REGULAR MEETING WAS HELD IMMEDIATELY FOLLOWING THE SPECIAL MEETING HELD ON APRIL 9, 2014. CALL TO ORDER WAS MADE BY CHAIRMAN JON DETTERY.

PUBLIC PARTICIPATION: ADELE ZAREMBA ASKED IF COPIES OF THE AGENDA COULD BE GIVEN PRIOR TO THE MEETING. CHAIRMAN DETTERY TOLD HER THEY WOULD BE AVAILABLE THE DAY OF THE MEETING. SOLICITOR CHARLES DECOSMO REPORTED THAT THERE WAS NO ACTION REGARDING THE CARGO AIRPORT, THEY ARE STILL WAITING FOR A BRIEFING SCHEDULE FROM THE COMMONWEALTH COURT. HE STATED THAT ATTORNEY KARPOVICH WILL BE ACTING CO-COUNSEL WITH REGARD TO THIS CASE. THE POST TRIAL BRIEFS WERE SUBMITTED IN THE 60-63 GREEN MOUNTAIN ROAD TAX APPEAL AT END OF MARCH AND WE ARE AWAITING A DECISION. WE RECEIEVED A DECISION FROM BOARD OF FINANCE AND REVENUE THAT THE APPEAL OF CARGILL WAS DENIED, THEREFORE ALLOWING A TRANSFER TAX OF APPROXIMATELY $45,000.00 TO BE PAID TO THE TOWNSHIP IF IT IS NOT APPEALED . THERE WAS A PENNDOT TRAFFIC STUDY DONE REGARDING TRAFFIC IN AND OUT OF EAGLE ROCK AND THERE IS NO WARRANT FOR A CHANGE OF SPEED LIMIT. HE ALSO ASKED WHERE THE TAX MONEY WOULD GO. SUPERVISOR ANTONELLI STATED IT WOULD GO IN THE GENERAL FUND. SOMEONE ASKED ABOUT A ROAD PAVING AND WAS TOLD BY SUPERVISOR ANTONELLI THAT THE APPLICATION TO DO IT WILL GO IN BY AUGUST AND IT SHOULD BE DONE IN 2015. SUPERVISOR BIROS STATED THAT IT COULD BE TEMPORARILY REPAIRED. A QUESTION ABOUT THE 941 TAX FILING WAS ASKED AND SUPERVISOR ANTONELLI ANSWERED THAT ALL TAXES WERE PAID AND PAID CORRECTLY. SOMEONE ASKED ABOUT A ROAD THAT THE AMBULANCE HAD A PROBLEM GOING OVER AND SUPERVISOR ANTONELLI STATED THAT THIS PARTICULAR ROAD CAN BE ADDED TO THE GRANT PROJECT TO BE DONE NEXT YEAR.

SHE WAS SWORN IN APRIL, 2012 AND BECAME AN ADDITIONAL CODE ENFORCEMENT OFFICER IN ADDITION TO BOB GARBARDI AND OFFICER HARRIS. AS SHE BEGAN ENFOCEMENT OF
THE CODE ON VIOLATERS WITHIN THE TOWNSHIP, SHE RECEIVED PHONE CALLS FROM SUPERVISOR ANTONELLI. SUPERVISOR ANTONELLI TOLD HER THERE SHOULD ONLY WARNINGS GIVEN TO THE RESIDENTS AFTER SHE HAD ISSUED A CITATION . IT WAS BROUGHT UP IN PUBLIC MEETING THAT THERE WAS NO WARNING TO BE GIVEN WHEN A BURN BAN IS ON IN THE TOWNSHIP. SHE ISSUED CITATIONS TO THE RESIDENTS AND AGAIN WOULD RECEIVE A CALL FROM MR. ANTONELLI TO ONLY
GIVE A WARNING. SHE KEPT TWO OF THE CITATIONS GOING BUT LOST BOTH BECAUSE OF THE WAY THE CODE ENFORCEMENT WAS WRITIEN. SHE STATED THAT WHEN THE SUPERVISORS TIE THE CODE ENFORCEMENT OFFICERS HANDS, THEY CAN’T DO THEIR JOB. SHE WOULD LIKE THIS BOARD TO RECONSIDER HER AS AN ADDITIONAL CODE ENFORCEMENT OFFICER FOR THE TOWNSHIP. AT THAT
MEETING ALSO SHE WAS TOLD BY SOMEONE ATIENDING THE MEETING AND NOT THE SUPERVISORS THAT THEY GOT RID OF All THE CODE ENFORCEMENT OFFICERS. SHE NEVER RECEIVED ANY NOTICE. AS FAR AS SHE KNOWS SHE IS STILL SWORN IN AS A CODE ENFORCEMENT OFFICER. SHE WAS NOT BEING PAID AND WAS DOING IT ON HER OWN TIME AND WOULD STILL LIKE TO DO IT. SECOND, SHE STATED THAT AFTER THE SNOW ON FRIDAY, WHEN SHE PULLED OUT AT 6:00am, THE 81NCHES OF SNOW ON FRANKLIN STREET HAD NOT BEEN TOUCHED. SHE ASKED THAT MAYBE IT COULD BE LOOKED AT SO THAT RESIDENTS GOING TO WORK CAN GET OUT.

ATIORNEY DECOSMO ASKED IF SHE HAD NOT RECEIVED ANY FORMAL NOTICE OF DISCHARGE. SHE STATED THAT IT HAD BEEN BROUGHT UP AT A MEETING BUT NEVER GOT ANY FORMAL NOTICE. SHE BELIEVES IT MAY HAVE BEEN AT THE OCTOBER, 2013 MEETING. ATIORNEY DECOSMO ASKED LINDA CROLL TO PROVIDE HIM WITH THE MINUTES FOR THAT MEETING WHICH HE WILL REVIEW. HE ASKED HER TO LEAVE HER INFORMATION SO HE COULD GET BACK TO HER.

PAM HARTZ VOLUNTEERED TO BE THE ANIMAL CONTROL ENFORCEMENT OFFICER FOR THE TOWNSHIP. SHE STATED THAT DURING THE WEEK SHE AND OFFICER HARRIS RESCUED THREE DOGS IN THE LOFTY AREA. THEY TOOK A CRATE FROM HER HOME AND SHE PROVIDED FOOD AND CARE FOR THEM OVERNIGHT UNTIL THEY WERE REUNITED WITH THEIR OWNERS. SHE STATED SHE PREVIOUSLY WORKED FOR FIVE YEARS WITH THE GAME COMMISSION AS A DEPUTY AND NOW WORKS FOR THE BUREAU OF PRISONS. SHE TRAPPED CATS IN THE PAST FOR THE TOWNSHIP AND HAS A CATCH POLE AND CRATES. SHE WOULD LIKE TO BE CONSIDERED FOR THE POSITION.

JOHN BIROS STATED THAT THEY COULD DEFINETELY TALK ABOUT IT AND POSSIBLEY MAKE A MOTION AT THE NEXT MEETING.

SOLICITOR’S REPORT: ATIORNEY DECOSMO STATED THAT JUDGE GOODMAN IN SCHUYLKILL COUNTY MADE A DECISION DENYING THE CARGO AIRPORT. HE FEELS GLADSTONE WILL APPEAL AND IT WILL END UP IN COURT. HE HAS BEEN REVIEWING THE FILE AND WILL FILE A BRIEF IN OPPOSITION IF THEY FILE AN APPEAL. SECOND, THERE WAS A TAX APPEAL TRIAL IN OCTOBER/NOVEMBER, 2013 WITH REGARD TO A PROPERTY IN THE INDUSTRIAL PARK AT 63-65 GREEN MOUNTAIN ROAD THAT IS PARTIALLY IN EAST UNION TOWNSHIP. WE ARE IN IT WITH ATIORNEYS FOR THE HAZLETON AREA SCHOOL DISTRICT AND SCHUYLKILL COUNTY TAX ASSESSORS. THE BUILDING WAS ASSESSED AT 30 MILLION DOLLARS AND THEY ARE TRYING TO APPEAL THE ASSESSMENT AND ASKING THAT IT BE ASSESSED AT A LOWER AMOUNT WHICH WOULD LOWER TAXES. BRIEFS ARE DUE MID MARCH. WE SHOULD HAVE SOMETHING BACK BY MID SUMMER ON THE APPEAL.
