MINUTES OF REGULAR MEETING OF EAST UNION TOWNSHIP SUPERVISORS

HELD ON JANUARY 6, 2014

CHAIRMAN OF THE BOARD, JON DETIERY CALLED THE MEETING TO ORDER. PRESENT AT THE MEETING WERE CHAIRMAN JON DETIERY, VICE-CHAIRMAN JOHN BIROS, TREAURER MARY STITZER, SOLICITOR CHARLES DECOSMO, LISA DAVIDSON AND LINDA CROLL SUPERVISOR DENNIS ANTONELLI WAS ABSENT.

MOTION WAS MADE BY JON DETIERY TO ACCEPT THE MINUTES OF THE LAST MEETING. JOHN BIROS OPPOSED.

MOTION WAS MADE BY JOHN BIROS THAT THE MINUTES OF THE LAST MEETING BE TABLED FOR FURTHER REVIEW, SECONDED BY JON DETIERY. All IN FAVOR, MOTION CARRIES. CORRESPONDENCE AND POLICE REPORT WERE READ BY LINDA CROLL
MOTION WAS MADE BY JON DETIERY TO ACCEPT THE CORRESPONDENCE AND POLICE REPORT, SECONDED BY JOHN BIROS. ALLIN FAVOR, MOTION CARRIES.

PUBLIC COMMENTS: TARA DOLZANI STATED THAT SHE WAS APPROACHED IN MARCH OF 2012 BY A TOWNSHIP SUPERVISOR AND OFFICER HARRIS TO BE A CODE ENFORCEMENT OFFICER FOR THE TOWNSHIP. SHE WAS SWORN IN APRIL, 2012 AND BECAME AN ADDITIONAL CODE ENFORCEMENT OFFICER IN ADDITION TO BOB GARBARDI AND OFFICER HARRIS. AS SHE BEGAN ENFOCEMENT OF
THE CODE ON VIOLATERS WITHIN THE TOWNSHIP, SHE RECEIVED PHONE CALLS FROM SUPERVISOR ANTONELLI. SUPERVISOR ANTONELLI TOLD HER THERE SHOULD ONLY WARNINGS GIVEN TO THE RESIDENTS AFTER SHE HAD ISSUED A CITATION . IT WAS BROUGHT UP IN PUBLIC MEETING THAT THERE WAS NO WARNING TO BE GIVEN WHEN A BURN BAN IS ON IN THE TOWNSHIP. SHE ISSUED CITATIONS TO THE RESIDENTS AND AGAIN WOULD RECEIVE A CALL FROM MR. ANTONELLI TO ONLY
GIVE A WARNING. SHE KEPT TWO OF THE CITATIONS GOING BUT LOST BOTH BECAUSE OF THE WAY THE CODE ENFORCEMENT WAS WRITIEN. SHE STATED THAT WHEN THE SUPERVISORS TIE THE CODE ENFORCEMENT OFFICERS HANDS, THEY CAN’T DO THEIR JOB. SHE WOULD LIKE THIS BOARD TO RECONSIDER HER AS AN ADDITIONAL CODE ENFORCEMENT OFFICER FOR THE TOWNSHIP. AT THAT
MEETING ALSO SHE WAS TOLD BY SOMEONE ATIENDING THE MEETING AND NOT THE SUPERVISORS THAT THEY GOT RID OF All THE CODE ENFORCEMENT OFFICERS. SHE NEVER RECEIVED ANY NOTICE. AS FAR AS SHE KNOWS SHE IS STILL SWORN IN AS A CODE ENFORCEMENT OFFICER. SHE WAS NOT BEING PAID AND WAS DOING IT ON HER OWN TIME AND WOULD STILL LIKE TO DO IT. SECOND, SHE STATED THAT AFTER THE SNOW ON FRIDAY, WHEN SHE PULLED OUT AT 6:00am, THE 81NCHES OF SNOW ON FRANKLIN STREET HAD NOT BEEN TOUCHED. SHE ASKED THAT MAYBE IT COULD BE LOOKED AT SO THAT RESIDENTS GOING TO WORK CAN GET OUT.

ATIORNEY DECOSMO ASKED IF SHE HAD NOT RECEIVED ANY FORMAL NOTICE OF DISCHARGE. SHE STATED THAT IT HAD BEEN BROUGHT UP AT A MEETING BUT NEVER GOT ANY FORMAL NOTICE. SHE BELIEVES IT MAY HAVE BEEN AT THE OCTOBER, 2013 MEETING. ATIORNEY DECOSMO ASKED LINDA CROLL TO PROVIDE HIM WITH THE MINUTES FOR THAT MEETING WHICH HE WILL REVIEW. HE ASKED HER TO LEAVE HER INFORMATION SO HE COULD GET BACK TO HER.

PAM HARTZ VOLUNTEERED TO BE THE ANIMAL CONTROL ENFORCEMENT OFFICER FOR THE TOWNSHIP. SHE STATED THAT DURING THE WEEK SHE AND OFFICER HARRIS RESCUED THREE DOGS IN THE LOFTY AREA. THEY TOOK A CRATE FROM HER HOME AND SHE PROVIDED FOOD AND CARE FOR THEM OVERNIGHT UNTIL THEY WERE REUNITED WITH THEIR OWNERS. SHE STATED SHE PREVIOUSLY WORKED FOR FIVE YEARS WITH THE GAME COMMISSION AS A DEPUTY AND NOW WORKS FOR THE BUREAU OF PRISONS. SHE TRAPPED CATS IN THE PAST FOR THE TOWNSHIP AND HAS A CATCH POLE AND CRATES. SHE WOULD LIKE TO BE CONSIDERED FOR THE POSITION.

JOHN BIROS STATED THAT THEY COULD DEFINETELY TALK ABOUT IT AND POSSIBLEY MAKE A MOTION AT THE NEXT MEETING.

TREASURER’S REPORT WAS NOT READ SINCE MR. ANTONELLI WAS ABSENT. ENGINEER’S REPORT FROM ARRO ENGINEERING WAS READ. MOTION WAS MADE BY JON DETTERY TO ACCEPT THE ENGINEER’S REPORT, SECONDED BY JOHN BIROS. ALL IN FAVOR, MOTION CARRIES.

SOLICITOR DECOSMO STATED THAT THERE WAS NO SOLICITOR’S REPORT. HE WAS AWAITING INFORMATION FROM ATIORNEY KARPOVICH. HE THANKED THE BOARD AND STATED HE WAS LOOKING FORWARD TO WORKING WITH THEM AND WITH EAST UNION TOWNSHIP.

CHAIRMAN OF THE BOARD, JON DETTERY, CALLED THE MEETING TO ORDER. PRESENT AT THE MEETING WERE CHAIRMAN JON DETTERY, VICE-CHAIRMAN JOHN BIROS, SUPERVISOR DENNIS ANTONELLI, ATIORNEY CHARLES DECOSMO, TREASURER MARY STITZER, AND SECRETARY LISA DAVIDSON.

THE PLEDGE OF ALLEGIANCE WAS DONE.

PUBLIC PARTICIPATION: PAUL ANDREUZZI ASKED IF THERE COULD BE AN INQUIRY DONE WITH REGARD TO NATURAL GAS BEING PROVIDED FOR THE TOWNSHIP. THIS WILL BE LOOKED INTO WITH UGI. SOLICITOR’S REPORT: ATIORNEY DECOSMO STATED THAT JUDGE GOODMAN IN SCHUYLKILL COUNTY MADE A DECISION DENYING THE CARGO AIRPORT. HE FEELS GLADSTONE WILL APPEAL AND IT WILL END UP IN COURT. HE HAS BEEN REVIEWING THE FILE AND WILL FILE A BRIEF IN OPPOSITION IF THEY FILE AN APPEAL. SECOND, THERE WAS A TAX APPEAL TRIAL IN OCTOBER/NOVEMBER, 2013 WITH REGARD TO A PROPERTY IN THE INDUSTRIAL PARK AT 63-65 GREEN MOUNTAIN ROAD THAT IS PARTIALLY IN EAST UNION TOWNSHIP. WE ARE IN IT WITH ATIORNEYS FOR THE HAZLETON AREA SCHOOL DISTRICT AND SCHUYLKILL COUNTY TAX ASSESSORS. THE BUILDING WAS ASSESSED AT 30 MILLION DOLLARS AND THEY ARE TRYING TO APPEAL THE ASSESSMENT AND ASKING THAT IT BE ASSESSED AT A LOWER AMOUNT WHICH WOULD LOWER TAXES. BRIEFS ARE DUE MID MARCH. WE SHOULD HAVE SOMETHING BACK BY MID SUMMER ON THE APPEAL.

OPPOSED BY DENNIS ANTONELLI, MOTION CARRIES. MR. ANTONELLI STATED THAT THERE MUST BE A PLACE DESIGNATED FOR THE EMPLOYEES TO SMOKE. ATIORNEY DECOSMO STATED THAT DOES NOT HAVE TO BE A DESIGNATED AREA IN THE BUILDING BUT A PLACE OUTSIDE COULD BE SET UP. IT WILL BE DECIDED WHERE THAT AREA WILL BE.
