MINUTES OF REGULAR MEETING OF EAST UNION TOWNSHIP SUPERVISORS

HELD ON MARCH 15, 2014

THE PLEDGE OF ALLEGIANCE WAS RECITED.

CHAIRMAN OF THE BOARD, JON DETTERY, CALLED THE MEETING TO ORDER. PRESENT AT THE MEETING WERE CHAIRMAN JON DETTERY, VICE-CHAIRMAN JOHN BIROS, SUPERVISOR DENNIS ANTONELLI, ATTORNEY CHARLES DECOSMO, TREASURER MARY STITZER, AND SECRETARY LISA DAVIDSON.

PUBLIC PARTICIPATION: ED SHAMANY ASKED TO HAVE THE PUBLIC PARTICIPATION HELD AT THE END OF THE MEETING. ATTORNEY DECOSMO EXPLAINED THAT IT WAS AT THE DISCRETION OF THE SUPERVISORS WHETHER TO HOLD PUBLIC COMMENT AT THE BEGINNING OR AT THE END OF THE MEETING. IT WAS AGREED BY THE SUPERVISORS TO HOLD COMMENT UNTIL THE END OF THE
MEETING.

MOTION WAS MADE BY DENNIS ANTONELLI TO ACCEPT THE MINUTES OF THE SPECIAL MEETING HELD ON DECEMBER 28, 2013, SECONDED BY JOHN BIROS. ALL IN FAVOR, MOTION CARRIES.

MOTION WAS MADE BY JOHN BIROS TO ACCEPT THE MINUTES OF REGULAR MEETING OF FEBRUARY 12, 2014, SECONDED BY JON DETTERY. ALL IN FAVOR, MOTION CARRIES.

MOTION WAS MADE BY DENNIS ANTONELLI TO ACCEPT THE TREASURER’S REPORT FOR FEBRUARY, 2014, SECONDED BY JOHN BIROS. ALL IN FAVOR, MOTION CARRIES.

MOTION WAS MADE BY JOHN BIROS TO ACCEPT THE CORRESPONDECE REPORT, SECONDED BY DENNIS ANTONELLI. ALL IN FAVOR, MOTION CARRIES.

MOTION WAS MADE BY JOHN BIROS TO ACCEPT THE POLICE REPORT, SECONDED BY DENNIS ANTONELLI. ALL IN FAVOR, MOTION CARRIES.

SOLICITOR’S REPORT: ATTORNEY DECOSMO STATED THAT GLADSTONE HAS APPEALED THE DECISION OF JUDGE GOODMAN REGARDING THE CARGO AIRPORT, WHICH WILL NOW GO TO COMMONWEALTH COURT. ONCE GLADSTONE FRAMES THEIR ISSUES ON APPEAL, ATTORNEY DECOSMO CAN RESPOND. A BRIEFING SCHEDULE WILL BE GIVEN BY THE COURT. EACH PARTY WILL SUBMIT A BRIEF AND A DECISION WILL BE MADE. HE WILL BE WORKING WITH SERVICE ELECTRIC’S ATTORNEY AND TOGETHER THEY WILL
PREPARE THE BRIEFS. A POST TRIAL MEMORANDUM WAS RECEIVED ON THE TAX APPEAL AND RESPONSIVE BRIEFS WILL BE PREPARED TOGTHER WITH THE HAZLETON AREA SCHOOL DISTRICT ATTORNEY. THERE WAS A REQUEST MADE TO PENDOT TO HAVE THE SPEED LIMIT REDUCED AT THE ENTRANCE OF EAGLE ROCK SINCE IT IS A HIGH TRAFFIC AREA.

MOTION WAS MADE BY JOHN BIROS TO ACCEPT THE SOLICITOR’S REPORT, SECONDED BY JON DETTERY. DENNIS ANTONELLI OPPOSED. MOTION CARRIES.

MOTION WAS MADE BY DENNIS ANTONELLI TO RETAIN ATTORNEY RON KARPOVICH AS SPECIAL COUNSEL FOR THE CARGO AIRPORT APPEAL. NO SECOND WAS MADE. JON DETTERY AND JOHN BIROS OPPOSED THE MOTION.

MOTION WAS MADE BY JOHN BIROS FOR THE PURCHASE/INSTALLATION OF MOTOROLA CM 200 VHF 45 WATT MOBILE RADIOS, 1 CM 200 VHF BASE STATION WITH POWER SUPPLY AND FCC LICENSE AT AN ESTIMATED COST OF $1,960.00, SECONDED BY JON DETTERY. OPPOSED BY DENNIS ANTONELLI. MOTION CARRIES.

MOTION TO PURCHASE COLD PATCH FROM HAZLETON MATERIALS AT $113.00 P/TON WAS MADE BY JOHN BIROS, SECONDED BY JON DETTERY. OPPOSED BY DENNIS ANTONELLI. MOTION CARRIES.
MOTION TO SCHEDULE SPRING CLEAN-UP FOR THE TOWNSHIP, END OF APRIL, BEGINNING OF MAY WAS MADE BY JOHN BIROS, SECONDED BY JON DETTERY. DENNIS ANTONELLI OPPOSED. MOTION CARRIES.
MOTION TO APPROVE REPOSITORY SALE OF PROPERTIES BY THE SCHUYLKILL COUNTY TAX CLAIM BUREAU WAS MADE BY JOHN BIROS, SECONDED BY JON DETTERY. ALL IN FAVOR, MOTION CARRIES.
MOTION TO APPROVE RENEWAL OF INSURANCE POLICY WITH KILMER GROUP WITH WORKER’S COMPENSATION CHANGES FOR PERIOD OF APRIL 1, 2014 THROUGH MARCH 31, 2015 WAS MADE BY JOHN BIROS, SECONDED BY JON DETTERY. ALL IN FAVOR, MOTION CARRIES.
MOTION TO APPROVE CHAMBER CHOICE ENERGY PROGRAM FOR PERIOD BEGINNING MAY 1, 2014 AND ENDING APRIL 30, 2017, WAS MADE BY JOHN BIROS, SECONDED BY DENNIS ANTONELLI. ALL IN FAVOR, MOTION CARRIES.

PUBLIC PARTICIPATION: CAROL ZIELINSKI HAD COMMENTS REGARDING THE AIRPORT ISSUE AND KEEPING ATORNEY KARPOVICH FOR THAT ISSUE. BILL GEORGE ALSO HAD COMMENTS REGARDING THE AIRPORT AND WANTED TO KNOW IF WE STILL HAD A POLICE OFFICER. ANN MARIE SHELBY, HAZLE TOWNSHIP, ADDRESSED THE PEOPLE ASKING WHY NOBODY ATTENDS THE PUBLIC MEETINGS IN POTTSVILLE. ED SHAMANY STATED THAT HE DID ATTEND ALL OF THE MEETINGS TOGETHER WITH THE POLICE OFFICER, BOB GABARDI AND DENNIS AND THAT HE CONTRIBUTED $5,000.00 TOWARDS IT EVEN THOUGH HE WAS NOT ON ANY COMMITTEES. ROSEANN EVANGELISTA WAS NOT HAPPY WITH ATTORNEY KARPOVICH NOT REPRESENTING THE TOWNSHIP AND HAD AN ISSUE WITH ATTORNEY FANELLI. TOM HOUSER HAD A QUESTION ABOUT THE PROCESS OF CHOOSNG THE TOWNSHIP ATTORNEY AND HOW A RETAINER FEE WORKS. MARGARET WOLFON FROM SUGARLOAF ASKED QUESTIONS REGARDING EXPERIENCE OF ATTORNEY SKOKOSKI/DECOSMO AND ATTORNEY KARPOVICH AND HAD AN ISSUE WITH NOT RETAINING ATTORNEY KARPOVICH. JILL CAREYVA ASKED ABOUT THE TOWNSHIP WORKERS BEING IN A UNION AND ASKED WHO PAYS THE UNION DUES. ADELE ZAREMBA WANTED TO KNOW IF ALL OF THE CELL PHONES HAVE BEEN COLLECTED SO THAT THE TAXPAYERS WON’T HAVE TO PAY FOR THEM ANY LONGER. SHE ALSO ASKED WHO HAS THE CELL PHONES AND STATED THAT SHE CHECKED AND NO OTHER TOWNSHIPS PAY FOR CELL PHONE FOR SUPERVISORS.

JERRY EVANGELISTA WANTED TO KNOW HOW MUCH DENNIS WAS BEING PAID TO BE TREASURER AND ROADMASTER AND WHAT IS BEING PAID NOW. HE ALSO WANTED TO KNOW WHERE THE COMPUTERS PURCHASED WILL BE AT. JOE BROWN STATED THAT JERRY IS LOSING INCOME FROM NOT BEING EMPLOYED BY THE TOWNSHIP ANY LONGER. JIM YURICK SAID HE WANTED THE NEW POLICE VEHICLE OUT OF HIS GARAGE. DREW MAGILL SPOKE ABOUT THE CARGO AIRPORT EXTENSIVELY. HE URGED TO KEEP RESISTING IT. LOIS CASEY HAD A COMMENT ON JON DETTERY AND JOE DELUCA BEING ROADMASTERS AND THE ISSUE WITH THE PAY THEY RECEIVED. JOE BROWN STATED THAT WHEN HE WAS EMPLOYED BY THE TOWNSHIP, JON DETTERY WAS THE ONLY SUPRVISOR WHO WORKED ALONGSIDE THE GUYS. BOB GABARDI REQUESTED THAT THE FIRE COMPANY LOT BE CLEARED FOR THE UPCOMING BINGO. CAROL ZIELINSKI STATED THAT THE SHEPPTON MINE DISASTER MARKER WA APPROVED AND WANTED TO SAY IT SHOULD BE MADE INTO SOMETHING SPECIAL. MARYANN PETRYLAK WANTED TO KNOW WHY MR. BIRISH DID NOT TELL THE PUBLIC THE ATTORNEY WAS ALSO HIS ATTORNEY. SHE FEELS THEY HAVE A RIGHT TO KNOW.

HELD ON APRIL 9, 2014

THE REGULAR MEETING WAS HELD IMMEDIATELY FOLLOWING THE SPECIAL MEETING HELD ON APRIL 9, 2014. CALL TO ORDER WAS MADE BY CHAIRMAN JON DETTERY.

PUBLIC PARTICIPATION: ADELE ZAREMBA ASKED IF COPIES OF THE AGENDA COULD BE GIVEN PRIOR TO THE MEETING. CHAIRMAN DETTERY TOLD HER THEY WOULD BE AVAILABLE THE DAY OF THE MEETING. MOTION TO APPROVE MINUTES OF REGULAR MEETING HELD MARCH 12, 2014 WAS MADE BY JOHN BIROS AND SECONDED BY JON DETTERY. ALL IN FAVOR, MOTION CARRIES.

MOTION TO APPROVE CORRESPONDENCE REPORT WAS MADE BY DENNIS ANTONELLI, SECONDED BY JOHN BIROS. ALL IN FAVOR, MOTION CARRIES.

MOTION TO APPROVE TREASURER’S REPORT OF MARCH 2014 WAS MADE BY DENNIS ANTONELLI, SECONDED BY JOHN BIROS. ALL IN FAVOR, MOTION CARRIES.

THERE WERE NO POLICE, ENGINEERS OR SEWER AUTHORITY REPORTS READ.

SOLICITOR CHARLES DECOSMO REPORTED THAT THERE WAS NO ACTION REGARDING THE CARGO AIRPORT, THEY ARE STILL WAITING FOR A BRIEFING SCHEDULE FROM THE COMMONWEALTH COURT. HE STATED THAT ATTORNEY KARPOVICH WILL BE ACTING CO-COUNSEL WITH REGARD TO THIS CASE. THE POST TRIAL BRIEFS WERE SUBMITTED IN THE 60-63 GREEN MOUNTAIN ROAD TAX APPEAL AT END OF MARCH AND WE ARE AWAITING A DECISION. WE RECEIEVED A DECISION FROM BOARD OF FINANCE AND REVENUE THAT THE APPEAL OF CARGILL WAS DENIED, THEREFORE ALLOWING A TRANSFER TAX OF APPROXIMATELY $45,000.00 TO BE PAID TO THE TOWNSHIP IF IT IS NOT APPEALED . THERE WAS A PENNDOT TRAFFIC STUDY DONE REGARDING TRAFFIC IN AND OUT OF EAGLE ROCK AND THERE IS NO WARRANT FOR A CHANGE OF SPEED LIMIT. MOTION TO APPROVE ORDINANCE NO. 2014-2 WAS MADE BY JOHN BIROS, SECONDED BY JON DETTERY. DENNIS ANTONELLI OPPOSED. MOTION CARRIES.

MOTION TO APPOINT LISA DAVIDSON TOWNSHIP MANAGER WAS MADE BY JOHN BIROS, SECONDED BY JON DETTERY. DENNIS ANTONELLI OPPOSED. MOTION CARRIES. MOTION WAS MADE TO ADVERTISE SPRING CLEAN UP SCHEDULE AS APRIL 23 THROUGH MAY 7, 2014 WAS MADE BY JOHN BIROS, SECONDED BY JON DETTERY. ALL IN FAVOR, MOTION CARRIES.

NEW BUSINESS:

MOTION TO APPROVE AMANDA MORRISON’S ACCEPTANCE OF THE 2013 GENERAL ELECTION WRITE-IN VOTE AS TOWNSHIP AUDITOR WAS MADE BY DENNIS ANTONELLI, SECONDED BY JOHN BIROS. ALL IN FAVOR, MOTION CARRIES.

PUBLIC PARTICIPATION: TOM HOUSER ASKED IF THE CARGILL MONEY WAS BACK TAXES. ATTORNEY DECOSMO EXPLAINED THAT IT WAS A ONE TIME TRANSFER TAX RELATIVE TO THE LEASE. HE ALSO ASKED WHERE THE TAX MONEY WOULD GO. SUPERVISOR ANTONELLI STATED IT WOULD GO IN THE GENERAL FUND. SOMEONE ASKED ABOUT A ROAD PAVING AND WAS TOLD BY SUPERVISOR ANTONELLI THAT THE APPLICATION TO DO IT WILL GO IN BY AUGUST AND IT SHOULD BE DONE IN 2015. SUPERVISOR BIROS STATED THAT IT COULD BE TEMPORARILY REPAIRED. A QUESTION ABOUT THE 941 TAX FILING WAS ASKED AND SUPERVISOR ANTONELLI ANSWERED THAT ALL TAXES WERE PAID AND PAID CORRECTLY. SOMEONE ASKED ABOUT A ROAD THAT THE AMBULANCE HAD A PROBLEM GOING OVER AND SUPERVISOR ANTONELLI STATED THAT THIS PARTICULAR ROAD CAN BE ADDED TO THE GRANT PROJECT TO BE DONE NEXT YEAR.
